MODULE 07 / LESSON 07

Texas & Houston Compliance Roadmap

What a convenience store or fuel retailer should verify before opening and during operation.

Learning target

Understand the principles, apply them to hypothetical retail operations, and distinguish evidence from assumptions. This is independent, unofficial educational content—not a professional credential.

1. Map your actual business model

Requirements differ for a fuel station, convenience store, deli, lottery retailer, tobacco seller, alcohol seller, check casher and car wash. Start with activities, physical location, ownership entity and jurisdiction. A permit for one activity does not automatically authorize another.

Owner practice / example

Maintain an applicability matrix: activity, agency, license/permit, responsible person, renewal deadline and proof.

2. Texas sales tax and tobacco permits

Texas retailers generally need to determine sales-and-use-tax obligations. Cigarette, cigar and tobacco sellers generally need a separate retailer permit for each qualifying business location, along with an active sales tax permit. Verify product-specific classifications and restrictions with the Texas Comptroller.

3. Alcohol and lottery

For off-premises alcoholic beverages, review the appropriate TABC license/permit type, local-option restrictions and authorized sales practices. The Texas Lottery has separate retail authorization, financial and inventory controls; applicants use its Retailer Wizard and official retailer guidance.

4. Underground storage tanks and fuel operations

For regulated UST facilities, TCEQ describes Class A, B and C operator roles. A/B operators use TCEQ-approved training; Class C has specific facility emergency-response training. Maintain compliance records for release detection, spill/overfill prevention, inspection, financial assurance and reporting as applicable. This independent lesson is not a TCEQ-approved course.

5. Food service and local requirements

A deli or food-preparation operation may have food-establishment permitting, handler/manager training, plan review and inspection obligations. Requirements vary by city limits versus unincorporated Harris County and by the activity. Confirm the address-specific authority and current application pathway before proceeding.

6. Fuel measurement, safety and employee rules

Investigate applicable motor-fuel measurement inspections, fire code, building/occupancy, environmental, ADA/accessibility, signage, OSHA and federal wage requirements. Rules and agencies can differ based on location and site configuration. Keep direct agency verification in your opening plan.

7. Renewal and evidence management

Maintain a calendar for registrations, permit renewals, staff training, inspections, food safety, tank tests and other site-specific obligations. Record issued documents and correspondence, plus owner and manager accountability. Some licenses are not transferrable when a business changes ownership.

Owner practice / example

Review requirements with relevant officials and licensed advisers before acquisition or opening; treat online summaries as orientation only.

8. Check cashing and other regulated services

Adding check cashing, money transmission, financial services, lottery, fuel or alcohol may trigger separate licensing, anti-money-laundering or financial-control duties. Before activating such services, obtain a transaction-specific review from official regulators and qualified advisers.

Owner practice / example

Do not use this general lesson as an authorization to perform regulated activities.
